THIS CONTEST IS OPEN TO CANADIAN RESIDENTS ONLY
AND IS GOVERNED BY CANADIAN LAW
1. CONTEST PERIOD:
The Shoppers Drug Mart/Pharmaprix® NBA All-Star Game 2018 Contest (the “ Contest”) begins on April 22nd, 2017 at 8:00 AM Eastern Time (ET) and ends on May 19th, 2017 at 9:00 PM Eastern Time (ET) (the “Contest Period”).
Contest is open to all legal residents of Canada who have reached the legal age of majority in their province/territory of residence at the time of entry. Employees of Unilever Canada Inc. (“Sponsor”), Shoppers Drug Mart Inc./Pharmaprix Inc. , the Associate/Owners of Shoppers Drug Mart and Pharmaprix stores, NBA Properties, Inc., the NBA, its member teams, and each of their respective parent companies, subsidiaries, affiliates, officers, governors, owners, distributors, retailers, advertising/promotion agencies (collectively, “Released Parties”), and the immediate family members (parent, spouse, sibling or child and their respective spouses, regardless of where they reside) and those living in the same household of each, whether or not related, are not eligible to participate or win a prize.
3. HOW TO ENTER:
No purchase necessary. There are three ways to enter the Contest, as follows:
Eligible Purchase: During the Contest Period, you can enter the Contest by: (i) purchasing a participating Unilever Men’s Personal Care product (an “Eligible Purchase”) at any participating Shoppers Drug Mart/Pharmaprix® store (each store a licensed operator of Shoppers Drug Mart Inc. “Shoppers Drug Mart” / Pharmaprix Inc. “Pharmaprix”); and (ii) visiting the NBA All-Star Game 2018 Contest microsite at (the “Website”) to fill out the Contest entry form (“Entry Form”), which includes a requirement to provide the UPC code from the participating Unilever Men’s Personal Care product you purchased. If you submit a fully completed Entry Form during the Contest Period, you will be eligible to receive one (1) entry into the Contest (an “Entry”), subject to your compliance with these Rules (as determined by the Sponsor in its sole and absolute discretion). IMPORTANT NOTE: You must retain the original printed UPC code(s) obtained via your Eligible Purchase for verification purposes (see below for details). Participating Products include:

Upon receipt of your Mail-in Request in accordance with these Rules, you will be eligible to receive one (1) Entry, subject to your compliance with these Rules (as determined by the Sponsor in its sole and absolute discretion). To be eligible, your Mail-in Request must be post-marked during the Contest Period and received by no later than five (5) days after the close of the Contest Period. The Sponsor takes no responsibility for any lost, stolen, delayed, illegible, damaged, misdirected, late or destroyed Mail-in Request. Limit of one (1) Entry per Mail-in Request. Each Mail-in Request must be mailed in a separate envelope bearing sufficient postage.
c. On-line Essay: If you would like to enter your Essay online instead of by mail, complete the Entry Form on the Website and choose the Essay option instead of entering the UPC Code (“Online Essay Entry”). Each Essay must be original and must be submitted during the Contest Period.
There is a limit of three (3) Entries per person/email address, regardless of the method of entry. If it is discovered that any person has attempted to: (i) submit more than three (3) Entries per person/email address, regardless of the method of entry; and/or (ii) use (or attempt to use) multiple names, identities and/or more than one (1) email address participate in this Contest; then (in the sole and absolute discretion of the Sponsor) he/she may be disqualified from the Contest and all of his/her Entries voided. Use (or attempted use) of multiple names, identities, email addresses, and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest is prohibited and is grounds for disqualification by the Sponsor. The Released Parties are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void).
IN NO EVENT AND UNDER NO CIRCUMSTANCES WILL ANY PERSON BE PERMITTED TO OBTAIN MORE THAN THE MAXIMUM NUMBER OF ENTRIES AS STATED IN THESE RULES.
All entrants, Eligible Purchases, Entry Forms, Essays, UPC codes, Online Essay Entries and Mail-in Requests are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Mail-in Request, UPC code, Online Essay Entry or Essay entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s). For greater certainty, the Sponsor reserves the right to request an entrant who has submitted an Entry Form to provide the applicable original printed UPC code(s) that correspond to the UPC code(s) he/she has submitted for verification purposes.
4. ENTRY REQUIREMENTS:
BY SUBMITTING AN ENTRY, YOU AGREE THAT THE ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES WILL BEAR NO LEGAL LIABILITY REGARDING THE USE OF YOUR ENTRY BY THE CONTEST PARTIES AND THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THESE RULES
5. THE GRAND PRIZE AND ITS APPROXIMATE RETAIL VALUE:
There will be one (1) grand prize available to be won, consisting of a trip for four (4) to the 2018 NBA All-Star Game, which is scheduled to take place on February 18, 2018 in Los Angeles, California, including: airfare (economy) for the winner and his/her three (3) travel companions to Los Angeles from the major Canadian airport nearest to the winner’s place of residence; accommodations (two (2) double occupancy rooms) for two (2) nights in a hotel to be chosen by the Sponsor in their sole and absolute discretion, four (4) tickets to the 2018 NBA All-Star Game and (1) Unilever gift basket, (collectively, the “ Grand Prize”). Approximate retail value of the Grand Prize: $15,000 CAD, based on a Vancouver hypothetical departure example.
The Grand Prize must be accepted as awarded and is not transferable or assignable (except as may be specifically permitted by Sponsor in its sole and absolute discretion). The characteristics and features of each Grand Prize element, unless otherwise explicitly described above, are at the Sponsor’s sole discretion. No substitutions except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute the Grand Prize or a component thereof with a prize or prizes of equal or greater value. The Grand Prize will only be awarded to the person who is verified as the “authorized account holder” (see below) of the email account associated with the selected Entry. There is a limit of one (1) Grand Prize. Any and all costs/expenses not specifically included in the Grand Prize description are the sole and absolute responsibility of the confirmed winner.
Without limiting the generality of the foregoing, the following general conditions apply to the Grand Prize: (i) the Grand Prize must be accepted as awarded and is not transferable or convertible to cash (no substitutions except at Sponsor’s option); (ii) all travel related to the Grand Prize must occur in a manner that is consistent with the scheduled date of the 2018 NBA All-Star Game (as specified above) unless Sponsor substitutes alternate dates (otherwise the Grand Prize will be forfeited in its entirety); (iii) the winner and his/her travel companions must: (a) travel on same itinerary; (b) have all necessary documentation to permit travel to Los Angeles; and (c) not have any legal barrier to entry into Los Angeles; (iv) the costs of everything not specifically stated above as included in the Grand Prize are the sole responsibility of the winner and his/her and travel companions, including, without limitation: meals and drinks; gratuities; entertainment; health and travel insurance; transportation for winner and his/her travel companions to and from the major Canadian airport nearest the winner’s residence; transportation while in Los Angeles; excess baggage fees; and items of a personal nature (NOTE: winner may be required to present a valid major credit card in winner’s name at the time of hotel check-in to cover any incidental expenses); (v) if the winner (and/or his/her travel companions) does not utilize any part(s) of the Grand Prize, then any such part(s) not utilized will be forfeited in its entirety and nothing will be substituted in its place; (vi) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Grand Prize or any component thereof; and (b) substitute the Grand Prize or a component thereof for any reason with a prize or a prize component of equal or greater value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (vii) all travel arrangements relating to the Grand Prize must be made through the Sponsor or its designated agents; (viii) by accepting the Grand Prize, the winner agrees to waive all recourse against the Releasees (defined below) if the Grand Prize or a component thereof does not prove satisfactory, either in whole or in part, including, without limitation, if the 2018 NBA All-Star Game is delayed, postponed, re-scheduled or cancelled for any reason; (ix) each of the winner’s travel companions must sign (and, if any travel companion is a minor, the confirmed winner must be his/her parent or legal guardian and must also sign) and return the Sponsor’s release (by the date indicated on the release form) indicating that he/she waives all recourse against the Releasees relating to his/her participation in the Grand Prize (including, without limitation, any travel related thereto; (x) all airline tickets are subject to availability at the time and shall be made at the Sponsor’s sole and absolute discretion; (xi) once booked, travel arrangements may not be changed by the Grand Prize winner or his/her travel companions; and (xii) neither Sponsor nor any of its prize suppliers will replace any lost or stolen tickets.
6. WINNER SELECTION:
At 12:00PM Eastern Time (ET) on June 9 , 2017 (the “ Draw Date”), in Toronto, Ontario, one (1) Entry will be selected by random draw from amongst all eligible Entries submitted and received in accordance with these Rules (as determined by the Sponsor at its sole discretion). In the event such selected potential Grand Prize winner is disqualified for failing to comply with these Rules, as determined by the Sponsor at its sole discretion, the Sponsor reserves the right in its sole discretion, to select an alternate potential Grand Prize winner through a random draw from among the remaining eligible Entries submitted and received in accordance with these Rules (as determined by the Sponsor at its sole discretion).
The odds of winning depend on the number of eligible Entries submitted and received in accordance with these Rules.
The Sponsor or its designated representative will make a minimum two (2) attempts to contact the potential Grand Prize winner within seven (7) business days of the Draw Date. If the potential Grand Prize winner cannot be contacted within ten (10) business days of the Draw Date, or if there is a return of any notification as undeliverable; then he/she will be disqualified (and will forfeit all rights to the Grand Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate potential Grand Prize winner from among the remaining eligible Entries submitted and received in accordance with these Rules (in which case the foregoing provisions of this section shall apply to such new potential Grand Prize winner).
Before being declared THE CONFIRMED GRAND PRIZE winner, the potential Grand Prize winner will be required to (a) correctly answer a time limited mathematical skill testing question, and winner and each travel companion (or his/her parent/legal guardian if a minor) must (b) sign and return within five (5) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Grand Prize as awarded; (iii) releases the Released Parties and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Grand Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor and/or the Released Parties in any manner whatsoever, including print, broadcast or the internet. If a potential Grand Prize winner: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; and/or (c) cannot (or is unwilling to) accept the Grand Prize as awarded for any reason; then he/she will be disqualified (and will forfeit all rights to the Grand Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate potential Grand Prize winner from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new potential Grand Prize winner).
7. GENERAL CONDITIONS:
ANYONE DETERMINED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.
Participants in this Promotion agree to be bound by these Official Rules and agree that: (a) Sponsor and The National Basketball Association (the “ NBA”), the NBA Member Teams, NBA Media Ventures, LLC, NBA TV, LLC, and NBA Properties, Inc. (collectively, the “ NBA Entities”) and their designees and assigns may use (unless prohibited by law) Participant’s name, voice, city/Province/Territory of residence, photographs, Essays, video or film clips, and/or other visual likeness for advertising and/or trade purposes and/or for any other purpose in any media or format now or hereafter known without further compensation (financial or otherwise), permission or notification; and
Sponsor and the NBA Entities and each of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, governors, owners, distributors, retailers, agents, assignees, advertising/promotion agencies, representatives, and agents shall have no liability and will be released and held harmless from any claim, action, liability, loss, injury or damage, including, without limitation (but subject to operation of law), personal injury or death to winner or any third party or damage to personal or real property due in whole or in part, directly or indirectly, by any reason, including the acceptance, possession, use or misuse of the prize and/or participation in this Promotion.
The Releasees will not be liable for: (i) any failure of any website during the Contest; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry to be received for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website or mobile network or mail delivery service interruptions or errors; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating or downloading any material in the Contest; and/or (v) any combination of the above.
In the event of a dispute regarding who submitted an Entry, the Entry will be deemed to have been submitted by the authorized account holder of the email address provided at the time of Entry. “Authorized account holder” is defined as the person who is assigned the email address by the email service provider responsible for the email address. An entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the email address associated with the selected Entry.
The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, subject only to the approval of the Régie, to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason.
For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of the prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entrants, Eligible Purchases, Entry Forms, Entries, UPC codes and/or Mail-in Requests.
The Sponsor reserves the right, subject only to the approval of the Régie, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
In the event of any discrepancy or inconsistency between the terms and conditions of the English version of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the French version of these Rules, website and/or point of sale, television, print or online advertising; the terms and conditions of the English version of these Rules shall prevail, govern and control.
8. INTELLECTUAL PROPERTY
All intellectual property used by the Sponsor in connection with the promotion and/or administration of the Contest, including, without limitation, all trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.
