THE TORONTO STAR WONDERLIST “Toronto FC” Contest OFFICIAL CONTEST RULES
Agreement: These rules govern the Toronto Star Wonderlist Toronto FC Contest (the “Contest”). No purchase is necessary to enter the Contest. The act of entering the Contest constitutes acceptance of these Contest rules and the decisions of the Sponsor, which decisions shall be final and binding upon all entrants.
Contest Sponsor: The Contest sponsor is Wonderlist, a property of Toronto Star Newspapers Limited (the “Sponsor”). “TORONTO FC” AND ASSOCIATED WORD MARKS AND LOGOS ARE TRADEMARKS, DESIGNS AND OTHER FORMS OF INTELLECTUAL PROPERTY OF MAJOR LEAGUE SOCCER, L.L.C., USED BY PERMISSION © 2017 MLS. ALL RIGHTS RESERVED.
Eligibility: The Contest is open to individuals who: (a) are current or new subscribers to Toronto Star Wonderlist; (b) are residents of Ontario; and (c) have attained the age of eighteen (18), all as at the start of the Contest Period. Notwithstanding the above, the Contest is not open to employees, immediate family members (i.e. spouses or biological, step or adoptive parents, children or siblings) or anyone domiciled with any employee of the Sponsor, Maple Leaf Sports & Entertainment Partnership and Maple Leaf Sports & Entertainment Ltd. and their affiliates (collectively “MLSE” or “Prize Supplier”), Toronto FC, Major League Soccer L.L.C. (“MLS”) and its member teams, Soccer United Marketing, L.L.C., MLS Canada ULC or any of their respective affiliates, subsidiaries, advertising or promotional agencies or fulfillment houses (altogether, the “Released Parties”).
Contest Period: The Contest begins at 9:00 AM ET on March 31, 2017 and ends at 9:00 am ET on April 14, 2017 (such period, the “Contest Period”).
How to Enter:There are two ways to enter the Contest and be eligible to win a prize:
(a) Online: during the Contest Period access the Contest website at http://wonderlist.ca/2017/03/torontofc, read and accept these Contest Rules, and follow the instructions to complete and submit a “Contest Entry Form” with all required information (a valid email address will be required) resulting in one (1) “Online Entry”. Each entrant may use only one (1) email address to enter the Contest. There is a limit of one (1) Online Entry per person per day; or
(b) Email: during the Contest Period, email firstname.lastname@example.org with the subject line “Toronto FC Contest”,your full name, email address, telephone number and an original 50 word essay about what type of contest you would like to see on Wonderlist, each resulting in one (1) “Email Entry”. There is a limit of one (1) Email Entry per person per day. Please note that each e-mail entry must be accompanied by a unique original essay.
(c) Bonus Entries: There is a limit of one (1) entry per person per day that can be obtained by submitting the online Contest Entry Form or an e-mail essay as outlined in (a) and (b) above. However, during the Contest Period, each Entrant may obtain additional entries into the draw (up to a maximum total of five (5) additional entries per day, each, a “Bonus Entry”) by either:
i. sharing the personal referral link that will be provided to the Entrant following the Entrant’s submission of the online Contest Entry Form. The entrant will automatically be granted one (1) Bonus Entry into the draw for each such referral who also submits a valid Contest Entry Form online. Each entrant may only enter using one email address. Entrants must use the personal referral link provided to refer only friends or family; no Bonus Entries will be provided for Entrants referring people with whom they have no personal or family relationship, and Entrants providing any such referrals will be disqualified from the Contest – see Section 10 below for details;
ii. emailing email@example.com with the subject line “TFC Contest”, your full name, email address, telephone number and an original 25 word essay about what type of contest one of your good friends might like to see on Wonderlist. Please note that each e-mail Bonus Entry must be accompanied by a unique original essay. Please do not include any personal information about your friends (e.g. your friends’ names or e-mail addresses) as part of your submission.
Incomplete or illegible entries, bulk drop-offs, photocopies, scanned copies, facsimiles or other mechanically or electronically reproduced entries will not be accepted and will be disqualified. Limit of one (1) Online Entry or E-mail Entry per person per day during the Contest Period.
Prizing: There are two (2) prizes available to be won during the Contest, consisting of:
(a) One (1) four-pack of tickets to see Toronto FC vs. Chicago Fire at BMO Field on Friday, April 21, 2017 at 7:30 pm (specific seat location in the sole discretion of the Prize Supplier).
(b) One (1) four-pack of tickets to see Toronto FC vs. Houston Dynamo at BMO Field on Friday, April 28, 2017 at 7:30 pm (specific seat location in the sole discretion of the Prize Supplier).
The approximate retail value of each Prize is one hundred seventy-six dollars ($176.00 CAD). A confirmed Prize winner is not entitled to any difference between the actual retail value of a prize and the approximate retail value stated herein. Unauthorized use, reproduction or resale of a Prize is prohibited. A Prize will not be replaced or replenished if lost, stolen, used incorrectly or without authorization. The Sponsor will not mail or courier a Prize and is not responsible for lost, stolen or unclaimed prizes. If a potential winner is unable or unwilling to accept or otherwise redeem any Prize on the terms under which it is awarded, the Prize shall be forfeited and no cash or substitutes will be provided in whole or in part. A Prize cannot be transferred or substituted and the event will not be rescheduled if a winner cannot attend.
All incidental costs and expenses associated with a Prize that are not specifically referred to herein, including, without limitation, transportation to and from any game for which tickets are issued, meals and beverages, souvenirs and items of a personal nature are not included and are the sole responsibility of each Prize winner and his/her guest.
Each Prize winner and his/her guest acknowledge and accept all risk of damages, injury or other loss incidental to any game for which tickets are issued, whether occurring before, during or after the game, and hereby voluntarily agree to assume the same. The Prize Supplier reserves the right to refuse admission and/or to expel from any game and/or any other aspect of a Prize, any person whose conduct is deemed to be objectionable. Expulsion from a game cancels the tickets for the offending individual(s) and the individual(s) thereupon forfeit(s) all claims with respect to the tickets. Participation in a Prize is subject to compliance with all applicable laws, by-laws, regulations and any applicable facility or carrier rules; failure to comply may result in non-admission or expulsion from further participation in the Prize.
The Sponsor reserves the right, in the event that a Prize, or any component of a Prize, cannot be awarded as described herein for any reason, to substitute the same for another prize or component of equal or greater value, without notice or liability. In the event that a substitute prize is awarded, such prize must be accepted as awarded and cannot be exchanged for cash (where applicable) or otherwise.
There is a limit of one (1) Prize of any kind per person during the Contest Period.
The odds of winning a Prize will depend on the number of eligible Entries during the Contest Period.
Winner Selection: Each winners will be chosen by random draw from among all eligible Entries received during the Contest Period. The draw will take place at the Sponsor’s offices located at One Yonge Street, 4th floor, Toronto, Ontario, Canada, M5E 1E6 at 10:00 am ET on April 14, 2017.
Each potential winner will be contacted by telephone or email by a representative of the Sponsor, and must reply within twenty-four (24) hours of the first attempt of contact to maintain eligibility. In order to be eligible to win, each potential winner must correctly answer a time-limited mathematical skill-testing question, without assistance or mechanical or electronic aid. If any potential winner cannot be contacted within this time period or fails to respond to any attempted contact, or incorrectly answers the skill-testing question posed by the Sponsor, such potential winner will be disqualified, his/her Entry will be declared null and void and the Sponsor reserves the right, in its sole and absolute discretion, to select, at random, another eligible Entry, in which event these provisions shall apply to such other eligible Entry.
Each potential winner must go to One Yonge Street, 4th floor, Toronto, Ontario, Canada, M5E 1E6, to collect the Prize won. If a potential winner does not claim the Prize within one (1) day of notification, another eligible Entry may be selected, in the sole discretion of the Sponsor, and the first potential winner will have no further claim to the Prize. The Sponsor will not mail or courier the Prize and is not responsible for lost, stolen or unclaimed Prizes. If a potential winner is unable or unwilling to accept or otherwise redeem any Prize on the terms upon which it is awarded, the Prize shall be forfeited and no cash or substitutes will be provided in whole or in part.
Release: Prior to receiving a Prize, each potential winner will be required to show valid photo ID and to sign a Declaration of Eligibility and Release form, releasing the Released Parties (as defined above) from any and all liability in connection with the Contest and/or the Prize, confirming compliance with these Contest Rules and consenting to the use of his or her name and photograph, in any and all forms of media, without further compensation, in any publicity carried out by the Sponsor, Prize Supplier and/or their respective advertising and promotional agencies. The Sponsor must receive the signed form within twenty-four (24) hours of notification or the Prize may be forfeited and awarded to an alternate Entrant, in the sole discretion of the Sponsor, time permitting.
Indemnity and Limitation of Liability:Entrants hereby release, waive and discharge any and all claims of damage, loss or causes of action (including, negligence) against the Released Parties, including (but not limited to) death, personal injury or loss or damage to property, which the Entrant or any of the Entrant’s representatives, heirs, next of kin or assignees (“Entrant’s Representatives”) may have or which may hereinafter accrue to the Entrant or Entrant’s Representatives , as a result of the Entrant’s participation in the Contest or the receipt or use of the Prize awarded herein. By participating in this Contest, each Entrant agrees to defend, indemnify and hold harmless the Released Parties from any and all damages, injuries, claims, suits, actions, causes of action, costs, expenses, liabilities or losses of any kind (including but not limited to lawyers’ fees) arising out of or relating to his/her participation in the Contest; receipt or use of any Prize; violation of any term of these Contest Rules or violation of any third party right, including without limitation any copyright, property, or privacy right; or the administration of the Contest and distribution of the Prizes.
Privacy: Sponsor uses personal contact information to administer this Contest, including contacting, announcing and promoting Prize winners and potential Prize winners. The Contest is run in compliance with the Toronto Star Newspapers Limited privacy code, which may be found in full at http://www.thestar.com/privacy.
Banning: The Sponsor may, in its sole discretion, prohibit any person from entering the Contest whom it believes to be abusing the Contest Rules. Such abuse includes entering false information and entering more times than permitted under these Contest Rules.
Other: This Contest is governed by the laws of Ontario and the laws of Canada applicable therein and is void where prohibited by law. The Sponsor reserves the right to cancel or modify the Contest or the Contest Rules at any time, without notice. Neither Sponsor nor Prize Supplier shall be liable for any lost, late, misdirected or stolen Entries or inability to process Entries, or for any errors, damage or negligence that may arise in connection with this Contest, including technical issues or failures on any website or software, viruses, website disruptions, malfunctions or website down-time, human error, personal injury or property damage incurred by any Entrant. Sponsor is not responsible for any errors or omissions in printing or advertising this Contest. Use of any automated system including robotic or form filling software to enter or participate in this Contest is prohibited and will result in disqualification of all Entries by anyone using such assistance.
All Entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. Potential winners may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the selected Entry. In the event of a dispute, Entries shall be deemed to be submitted by the “Authorized Account Holder” of the email address on the Contest Entry Form or on the Email Entry. “Authorized Account Holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted email address.
Prize Supplier: By entering the Contest, each Entrant acknowledges and agrees that MLSE’s sole and exclusive role in the Contest is that of Prize Supplier and that MLSE is in no way responsible for the administration of the Contest or the selection of winners and that all such responsibility rests with the Sponsor.
