Contest brought to you by Tangerine Bank (“Tangerine” or “Sponsor”) with its head office located at 3389 Steeles Avenue East, Toronto, Ontario M2H 0A1. No purchase necessary. Contest is void in whole or part where prohibited by law. See Eligibility section below for further details. Participation in the Contest constitutes full and unconditional agreement and acceptance of these Rules and Regulations (which may be amended by Tangerine Bank from time to time in its sole discretion). All dollar amounts are in Canadian funds ($CDN) unless otherwise noted.
1. Contest Period:
The Tangerine Forward Thinking Contest (the “Contest”) will begin on May 31, 2018 at approximately 8:00 am ET and will end on July 31, 2018, 11:59pm ET (the “Contest Period”).
Contest is open to all legal residents of Canada (excluding Quebec) who have reached the legal age of majority in their province/territory of residence at the time of entry, except employees of Tangerine or any of its affiliates (including Scotiabank®), (and those with whom such employees are domiciled), shareholders or agents of Sponsor, and their advertising and promotional agencies (“Contest Parties”).
3. How to Enter:
No purchase necessary. To enter the Contest, entrants must follow these steps:

For mail-in entries:
To enter without subscribing to the monthly Forward Thinking content roundup, write a one (1) paragraph letter describing why you like no-fee daily banking, along with your name, phone number and mailing address and mail in the entry to: Tangerine Forward Thinking Contest, 3389 Steeles Avenue East, Toronto, Ontario M2H 0A1 Mail-in entries must be postmarked prior to the end of the Contest Period.
There is a limit of one (1) entry per person/email address or mail-in entry. Entrants may only use the Contest website or the mail-in entry to enter the Contest one (1) time in total. Potential winners may be required to provide Tangerine Bank with proof that the potential winner is the authorized account holder of the email address associated with the winning entry. If it is discovered that an entrant has attempted to: (i) enter more than one (1) time or (ii) use or (attempt to use) multiple names, email addresses or identities to enter, or otherwise participate in, the Contest, then (in the sole and absolute discretion of the Sponsor) he/she may be disqualified. Use (or attempted use) of multiple identities, mail-in envelopes, email addresses and/or any automated system to enter or otherwise participate in this Contest is prohibited and is grounds for disqualification.
Entrants will be able to unsubscribe from receiving email communication messages from Tangerine Bank at any time.
4. Eligibility Requirements:
By claiming a prize, you agree that you have complied with all conditions stated in these rules. The releases (defined below) will bear no legal liability regarding the use of your entry and shall be held harmless by you in the event it is subsequently discovered that you have departed from or not fully complied with and of these rules.
5. Prize and Approximate Retail Value:
(1) $1,500.00 Prepaid Mastercard Gift Card (the ‘Prize’).
There will be one (1) prize (the “Prize”) available to be won consisting of a Prepaid Mastercard Gift Card with an approximate retail value of $1,500.00. Prize includes all applicable fees and taxes, and the following conditions apply: (i) Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions except at Sponsor’s option; (iii) Sponsor reserves the right at any time to substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award.
The characteristics and features of each Prize element, unless otherwise explicitly described above, are at the Sponsor’s sole discretion. No substitutions except at Sponsor’s option. Any and all costs/expenses not specifically included in the Prize description are the sole and absolute responsibility of the confirmed winner.
6. Winner Selection:
At 10:00am ET on August 9, 2018 (the “Draw Date”), at 3389 Steeles Avenue East, Toronto, Ontario M2H 0A1, the Prize winner will be selected by random draw from among all eligible entries submitted in accordance with these Rules (as determined by the Sponsor at its sole discretion).
Odds of winning depend upon the total number of eligible entries received by the Sponsor during the Contest Period.
The Sponsor or its designated representative will make a minimum two (2) attempts to contact the selected potential Prize winner within seven business days of the Draw Date. If a selected entrant can’t be contacted within seven business days of the Draw Date, or if there is a return of any notification as undeliverable, then the selected entrant will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining applicable eligible entries (in which case the foregoing provisions of this section will apply to the new selected entrant).
Before being declared a confirmed Prize winner, each selected entrant will be required to (a) correctly answer a time limited mathematical skill testing question, and (b) sign and return within five (5) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases Tangerine Bank and each of its respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, and (iv) agrees to the publication, reproduction and/or other use of the winner’s name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the Internet and grants to the Sponsor, in perpetuity, a non- exclusive licence to publish, display, reproduce, modify, edit or otherwise use the material contained in the entry, in whole or in part, for advertising or promoting the Contest or for any other reason and waives all moral rights in and to the winner’s entry in favour of the Sponsor. If a selected entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; and/or (c) can’t (or is unwilling to) accept his/her Prize as awarded for any reason; then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining applicable eligible entries (in which case the foregoing provisions of this section shall apply to such new selected entrant).
7. General Conditions:
Anyone determined by the Sponsor to be in violation of these rules for any reason is subject to disqualification in the sole and absolute discretion of the Sponsor at any time.
By participating in this Contest, each entrant: (i) agrees to be bound by these Rules; and (ii) releases the Releasees from any and all liability in connection with this Contest and his/her participation. All entries become the property of the Sponsor.
The Releasees will not be liable for: (i) any technical malfunction or other problems relating to the telephone network or lines, computer online systems, servers, access providers, computer equipment or software; or (ii) the failure of any entry to be received for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website or mobile network or entry being late, lost, stolen, delayed, misdirected, mutilated, incomplete, unreadable, postage due, garbled or unintelligible.
The Sponsor reserves the right to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. The Sponsor reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason.
This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entrants or entries.
The Sponsor reserves the right to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials including, without limitation, the French version of the Rules, the terms and conditions of these English Rules shall prevail, govern and control.
By entering the Contest, all entrants expressly consent to the collection, use and distribution of their personal information by the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her entry for the purpose of (i) running the Contest (ii) as permitted by these Rules (for example, pursuant to these Rules, all entrants who accept a Prize consent to the use of their personal information for publicity use including as permitted by any release signed).
9. Governing Law
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Contest Rules, or the rights and obligations of entrant and the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario and the applicable federal laws without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.
