1. SPONSOR: The ONE CANADA DESIGN CONTEST (the “Contest”) is sponsored by Global Protection Corp., 12 Channel St., Boston, MA 02210 USA (“ONE”).

2. ELIGIBILITY: The Contest is open to legal residents of Canada who live, work or study within Canada who are 18 years of age at the time of entry and who have a physical address in Canada, with the exception of employees of ONE and its parent, related and affiliated companies, subsidiaries, suppliers, advertising and promotional agencies, contest administrators, and any other parties engaged in the development, production or distribution of Contest materials, and members of the immediate family (spouse, parent, siblings and children) and those living in the same household as the foregoing. By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules, including but not limited to the eligibility requirements set out herein. Entrants who do not comply with any of the Contest Rules are subject to disqualification by ONE, in its sole discretion.

3. CONTEST DATES AND TIMES: The Contest starts on March 16th, 2017 at 12:00pm EST and ends on May 7th, 2017, at 11:59 p.m. EST (the “Contest End Date”), after which time the Contest will be closed and no further entries shall be accepted. The sole determinant of time for the purpose of a receipt of a valid entry will be ONE’s web server machines.

4. HOW TO ENTER: Go to the ONE Canada Design Contest website located at and follow the links and instructions to submit your condom wrapper design (the “Artwork”) and complete your online entry form. For purposes of this Contest, “receipt” of an Internet entry occurs when ONE’s servers record the entry information and entry. Limit of three (3) separate design entries per person.

Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple accounts, identities, or registrations, all in ONE’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize. Entry forms that contain false or incomplete information may be void. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of the Contest Rules will be deemed void. All entries become the property of ONE upon receipt and none will be returned, unless they are rejected due to violating these Contest Rules, however there shall be no restrictions on entrants’ use of their own Artwork except that such Artwork may not be used in connection with any condom wrapper design(s). No correspondence will be entered into except with selected entrants. ONE may notify those entrants whose designs are rejected due to violation of these Contest Rules. Proof of transmission (screenshots or captures, etc.) does not constitute proof of receipt. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the ONE’s web server machines.

5. ARTWORK GUIDELINES: Artwork submitted must have a minimum of 300 dpi and at least 400 x 400 pixels. Required file format for upload is png or jpg. The final condom wrapper is round in shape with a diameter of 2.5 inches.

Artwork may be a drawing, photo, or design. All Artwork must be original; no stock photography or copyrighted images may be used or duplicated without appropriate rights and free of any claims for use of secondary artwork. Entrant agrees and acknowledges that there will be no compensation of calculable monetary value for Artwork usage.

No images will be accepted with trademarked material, such as Canadian sports teams and stadiums, or trademarked logos, structures or buildings (including the CN Tower). Any questions whether an image or design violates copyright / trademark can be directed to:

Artwork must be appropriate for all audiences. The Artwork (i) may not be inappropriate, indecent, offensive, libelous or defamatory, pornographic, sexually explicit, unlawful or plagiarized, or disparaging to ONE as determined solely by ONE; (ii) must not be harassing, abusive, threatening, harmful, vulgar, profane, obscene, excessively violent, racially, ethnically or otherwise objectionable or offensive in any way, as determined solely by ONE; (iii) may not violate or encourage others to violate any applicable law, statute, ordinance or regulation; (iv) may not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights; (v) may not contain commercial advertising, including but not limited to logos, brand names, and slogans, ONE or the Contest; (vi) may not include any viruses, worms, corrupt files, Trojan horses, or other forms of corruptive code or content that may harm or interfere with the Contest website, any third party websites and/or the proper conduct of the Contest; and (vii) if found to be in violation of these Contest Rules will be disqualified from the Contest.

All Artwork submissions fashioned into a circular shape and featuring the ONE® logo become the property of Global Protection Corp. and may be reproduced by Global Protection Corp. on ONE® Condoms wrappers and in any all media now known or hereafter developed for commercial and non-commercial purposes alike. By submitting Artwork, entrant: (i) certifies that s/he created the submission and has the right to provide it to Global Protection; and (ii) agrees to indemnify Global Protection Corp. from and against any claims, actions, suits and all related liabilities, damages and expenses incurred by Global Protection Corp. arising out of or relating to any alleged infringement of any copyright, trademark or other intellectual property rights of any third party. Each entrant hereby grants ONE a non-exclusive, perpetual, irrevocable, royalty-free, fully paid-up, worldwide license to his/her Artwork submitted in connection with the Contest.

6. CONTEST PRIZES: There are a total of ten (10) prizes available to be won as follows below. ONE may also choose an unlimited number of “Staff Picks”, selected by ONE in its sole discretion among eligible entrants who submitted designs that the Sponsor deems, in its sole discretion, as being worthy of recognition for being consistent with ONE’s brand standards and the overall mission and purpose of the Contest (including the promotion of public health and safety and celebrating Canadian life, culture and/or history), but which were not selected as winners by way of the voting and points reward processes described in section 8 below.

The Contest Judges will select a “Regional Winner” from each of the following five designated regions: (1) Northern Canada (Yukon, Northwest Territories Nunavut); (2) Western Canada (British Columbia, Alberta, Saskatchewan, Manitoba); (3) Atlantic Canada (Newfoundland and Labrador, New Brunswick, Prince Edward Island, Nova Scotia); (4) Ontario; and (5) Quebec. The address as submitted in each entrant’s profile will determine his/her regional eligibility.

Taxes, if any, are the responsibility of all prize winners. All winners assume any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this promotion or use or redemption of a prize. The Prizes are non-transferable, non-refundable and non-changeable once issued, must be accepted as awarded and have no cash value. The prizes (or any portion thereof) cannot be combined with other discounts, promotions or special offers. Winners may not transfer, modify, or substitute any prizes. ONE reserves the right to substitute an alternate prize of equal or greater value if advertised prize is unavailable at time of award. No more than the stated number of prizes specified in these Contest Rules will be awarded.

7. ODDS OF WINNING: The odds of winning depend on the number of eligible entries, the level of design skill, and how well the designs depict the over all theme of celebrating Canadian life, culture and/or history, in the view of any judging panel(s) and the general voting public.

8. WINNER SELECTION AND CONFIRMATION: On or about May 8th through 10th, 2017, ONE will review all submitted designs. Based on its sole discretion and with reference to the objectives of the Contest as expressed in these Contest Rules, the judging panel of ONE employees, as selected by ONE, will determine the top 100 designs from all eligible entries which will move onto the next judging round. On or about May 11th through May 18th, 2017, a judging panel selected by ONE (the “Judges”) will use the same criteria to determine the top 50 designs (the “Finalists”) from the selection presented to it, and award points to each based on a scoring system determined by ONE. The Judges will be comprised of 4-8 individuals, including representatives from the sexual health industry, media influencers and the design industry, all as selected by ONE. Following the completion of the second round of judging, on or about May 24th, 2017 at approximately 11:00 AM EST, the Finalists will be posted to From that date until July 3rd, 2017 at 11:59 PM EST, Canadian residents will be able to visit the foregoing website and vote for their favorite design among the Finalists. There is no limit on the number of votes or frequency of votes which can be submitted by voters. Each vote will represent one ‘point’, except that if a voter elects to vote for up to 5 Finalists in his/her ‘Favourites Tray’, each such vote will represent 5 points.

Use of any device, bots, macros, scripts or other technical means for automating voting is prohibited. ONE’s computer is the official device for the Contest and is not responsible for votes not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems. Voter registration data will be kept in strict confidence and used only for verification, to ensure a fair voting process. Votes will not count if the voter does not accurately complete all of the required fields on the registration form or if the registrant attempts to enter fraudulent data. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such attempt be made, ONE reserves the right to seek damages to the fullest extent permitted by law.

During the week of July 4th, 2017, ONE will confirm the grand prize winner, runners-up, Regional Winners and Staff Picks (collectively, the “Selected Entrant(s)”) based on the number of votes (other than the Staff Picks which are not subject to voting). The grand prize “Canada Winner” is the design with the most votes as determined by public voting, followed by the 4 “Runners-Up” with the 2nd, 3rd, 4th, 5th highest number of votes. The 5 Regional Winners will be separately decided on by the Judges, based on quality and creativity of the design and how well it represents the respective geographic region described above.

The Selected Entrant(s) will be deemed a winner(s)/runner(s)-up if they meet all of the eligibility criteria set out in these Contest Rules. If a Selected Entrant does not meet the eligibility criteria, he/she will be disqualified and will not receive a prize and another entrant will be selected based on the next highest vote total. Before being declared a winner/runner up, a Selected Entrant will be required to: (i) comply with all Contest Rules; and (ii) sign and return a release form, all in ONE’s sole discretion.

THE SELECTED ENTRANTS WILL BE NOTIFIED BY E-MAIL OR TELEPHONE BETWEEN July 11th, 2017 and July 18th, 2017. The Selected Entrants will be contacted using the e-mail address or telephone number provided at the time of entry into the Contest. Upon notification, Selected Entrants must respond by e-mail, confirm eligibility, and complete all required releases within 5 business days. If a Selected Entrant does not respond in accordance with these Contest Rules, he/she will be disqualified, will not receive a prize, and another entrant will be selected based on the next highest vote total. ONE is not responsible for the failure for any reason whatsoever of a Selected Entrant to receive notification or for ONE to receive a Selected Entrant’s response.

ONE will announce the final winners via a press release, social media, and website content posted to during July 2017.

Disputes regarding identity of entrant: If the identity of a Selected Entrant is disputed, the entry will be deemed to have been submitted by the Authorized Account Holder (the individual assigned to the e-mail address for the domain associated with the submitted e-mail address). Each Selected Entrant may be required to provide proof that he/she is the Authorized Account Holder of the e-mail address associated with the selected entry.

9. RELEASE AND INDEMNIFICATION: Each Selected Entrant must provide proof of identification and sign a release form to: (i) confirm compliance with the Contest Rules; (ii) agree to accept the prize as awarded; (iii) release, discharge and hold harmless ONE, and each of its respective departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (“Released Parties”), from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a prize, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner with any aspect of the Contest or any prize, liability for physical injury, death, or property damage which the entrants, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of the entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of the prizes as awarded; and (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by an entrant with any of the Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a prize.

Signed release forms must be returned to ONE by e-mail within five (5) business days after they were sent to a Selected Entrant.

ONE is not responsible for: (i) incorrect or inaccurate entry information which may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, omission, or any combination thereof, and entries which fail to fully comply with these Contest Rules; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) lost, incomplete, delayed, mutilated or misdirected entries or Declaration and Release forms; (iv) injury or damage to the entrant’s computer or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding the Contest or accepting a prize; (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer “hackers” or otherwise; or (vii) late, lost, misdirected or unsuccessful efforts to notify a potential winner; any part of a Contest prize that cannot be awarded due to acts of God, acts of war, natural disasters, weather, acts of terrorism or other factors beyond the Released Parties’ control.

10. CONDUCT: ONE reserves the right, in its sole discretion, to disqualify any entrant it finds to be: (i) violating these Contest Rules; (ii) tampering or attempting to tamper with the entry process or the operation of the Contest; (iii) acting in an un-sportsperson-like or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; (iv) using a devise to automate voting or to submit votes for a particular design in ways other than those intended within the contest rules. Any attempt by an entrant or any other individual to undermine the legitimate operation of the Contest may be a violation of criminal and/or civil laws. Should any such attempt be made, ONE reserves the right to seek remedies and damages to the fullest extent permitted by law.

11. MISCELLANEOUS: ONE reserves the right to terminate or amend this Contest at any time and in any way, without prior notice. Without limiting the foregoing, if, for any reason (including tampering), the Contest is not capable of running as originally planned, ONE reserves the right to cancel the Contest and select a Selected Entrant based on the selection criteria above based on all eligible entries received by the Contest End Date.

Participation in the Contest and/or acceptance of prize(s) constitutes entrant’s and/or Selected Entrants’ permission for ONE or its designees to interview the winner(s), to photograph, film and record each winner and guest and to use in any media, now or hereafter known, throughout the world, in perpetuity, his/her name, design(s), Artwork, prize(s) won, biographic information, likeness, photograph, voice, audio or video recording and/or any statements made by him/her regarding the Contest for purposes publicity or promotion without notice or additional compensation, notification or permission, in perpetuity, except where prohibited by law. Each Selected Entrant agrees to sign a publicity release confirming such consent prior to acceptance of the prize, except where prohibited by law.

The Contest is void where prohibited by law and is subject to all applicable Canadian federal, provincial, territorial, municipal and local laws. The Contest and these Contest Rules shall be governed exclusively by the laws of the province of Ontario and the federal laws of Canada applicable therein, and any dispute shall be adjudicated by the courts sitting in Toronto, Ontario.

Personal information collected from entrants will also be used by ONE for the purpose of administering this Contest and in accordance with ONE’s privacy policy which can be found at Personal information may be collected, used or disclosed in jurisdictions other than Canada. Personal information that resides in jurisdictions other than Canada will be subject to the general laws of application in those jurisdictions. ONE will not sell, share or otherwise disclose personal information of entrants with third parties or agents, other than to third parties or agents engaged by ONE to fulfill the above purposes or as permitted or required by the applicable laws. ONE reserves the right, in their sole discretion, to amend or modify these Contest Rules, or modify, cancel or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond ONE’s reasonable control corrupts, or threatens to corrupt, the security or proper administration of the Contest. If the Contest is terminated before the Contest End Date, ONE reserves the right to modify the procedure for selecting winner(s), unless the nature of the event giving rise to such termination renders it impossible to select winner(s).

All intellectual property of ONE, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are individually owned by ONE. All rights are reserved. Unauthorized copying or use of any copyrighted material or other intellectual property without the express written consent of ONE is strictly prohibited.

ONE reserves the right, subject to the approval of the Régie des alcools, des courses et des jeux (“Régie”), to withdraw or amend this contest in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of ONE that interferes with the proper conduct of this contest as contemplated by these rules.
