Contest Rules and Regulations

The “Retreat Yourself” contest (the “Contest”) is sponsored by Martin’s Family Fruit Farm (“Sponsor”). The Contest is governed by these official rules (“Official Rules”). By participating in the Contest, each entrant agrees to abide by, and confirm their eligibility in accordance with, these Official Rules, including all eligibility requirements, and understands that the results of the Contest, as determined by Sponsor and its agents, are final in all respects. The Contest is subject to all federal, provincial and local laws and regulations and is void where prohibited by law.

The Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook. Any questions, comments or complaints regarding the promotion will be directed to Sponsor, not Facebook.

ELIGIBILITY: The Contest is subject to the laws of Canada and is open to legal residents of Canada (excluding the residents of Quebec) who have reached the age of majority in his/her province or territory of residence, are nineteen (19) years of age or older at the time of entry and who have a valid Facebook account prior to the beginning of the Contest Period, with the exception of employees, agents and representatives of the Organizer, its subsidiaries, affiliates, affiliated companies, advertising or promotion agencies, the suppliers of material, prizes and services related to this Contest, and any other stakeholder directly related to the holding of the Contest, as well as the members of their immediate family (father, mother, brothers, sisters, children and legal or de facto spouse) and anyone with whom these employees, representatives and agents reside. Sponsor has the right to verify the eligibility of each entrant.

CONTEST PERIOD: The Contest begins at 12:00:01 am Eastern Time (“ET”) on March 5, 2018 and ends at 11:59 pm ET April 8, 2018 (the “Contest Period”). All entries must be received during the Contest Period. Sponsor reserves the right to extend or shorten the contest at their sole discretion.

HOW TO ENTER: No purchase necessary. To enter the contest you must be logged in to your Facebook account and click the Like button on the Sponsor Facebook Page (the “Contest Website”) located at https://www.facebook.com/martinsapplechips. After liking the Sponsor page, the entrant will be eligible for one (1) entry into the Contest. You may also enter the Contest by commenting on the pinned Contest post during the campaign period, or sharing the pinned Contest post. Limit of one (1) Contest entry per person during the Contest period.

WINNER SELECTION: All eligible entries received during the Contest Period will be entered into a random draw to be conducted on or around April 10, 2018. The odds of winning depend on the number of eligible entries received during the Contest Period.

The Sponsor or its designated representative will make a minimum of two (2) attempts to contact the selected entrant through Facebook’s private messaging service, within five (5) business days of the Draw Date. If a selected entrant cannot be contacted within five (5) business days of the Draw Date, or if there is a return of any notification as undeliverable; then he/she will be disqualified (and will forfeit all rights to a Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected entrant). Each entrant is responsible for monitoring his/her Facebook account for prize notification and receipt or other communications related to the Contest. If a selected entrant cannot be reached by the Sponsor within fifteen (15) days using the contact information provided at the time of entry, that selected entrant shall be disqualified and forfeit the Prize.

Before being declared the confirmed Prize winner, the selected entrant will be required to: (a) correctly answer a mathematical skill‑testing question without mechanical or other aid; and (b) sign and return within ten (10) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the Sponsor and its officers, directors, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet. If a selected entrant: (a) fails to correctly answer the skill‑testing question; (b) fails to return the properly executed Contest documents within the specified time; and/or (c) cannot accept a Prize as awarded for any reason; then he/she will be disqualified (and will forfeit all rights to a Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected entrant).

PRIZE: There is one (1) prize (the “Prize”) available to be won, consisting of one (1) trip for two (2) adults to Boulders Resort & Spa in Carefree, Arizona, worth a maximum value of $4,500 CAD.

This prize* includes:
  – a roundtrip economy-class airfare from the nearest major metropolitan airport to the Winner’s city of residence, to Phoenix, Arizona on the Sponsor’s airline of choice;
  – ground transfer to and from, between the Phoenix Sky Harbor International Airport and Boulders Resort & Spa for two (2) adults;
  – a 4 (four) night stay for two (2) adults in the North Casita accommodations at Boulders Resort & Spa;
  – Daily Spa membership (includes full use of the Fitness Centre and Yoga Classes, access to Sauna, Steam Room, O’Furo Japanese Bath, Spa Pool and Café);
  – 50-minute Spa Treatments for two;
  – Round of Golf on a championship Golf Course (club rentals included);
  – Sonoran Explorin’ Guided Tour;
  – Dinner for 2 at the Spotted Donkey Cantina.

*Travel must occur between May 15 – Sept 15, 2018; based on availability; valid for 1 year from prize award date. Blackout dates may apply.

ADDITIONAL LIMITATIONS: Prize is non‑transferable. No substitution or cash equivalent of prizes is permitted. All other costs and expenses associated with the Prize, including without limitation all transportation, travel insurance, additional accommodations and meals if required, gratuities, personal insurance, taxes and items of a personal nature are the responsibility of the winner. All aspects of prize are subject to availability and subject to change. The Sponsor reserves the right to make substitutions of prize elements in its sole discretion. Some additional restrictions may apply. Winner will be provided with all Prize details at time of prize fulfilment.

The Winner’s travel companion has been designated as the person who will become the travel companion of the Winner for the purposes of the Prize (the “Travel Companion”) and shall be a Canadian resident who has reached the age of majority in his/her province of residence on April 10th, 2018. The Winner’s Travel Companion shall also sign and remit to the Sponsor a duly completed Sponsor’s release form within ten (10) business days after its receipt, failing which he/she may not receive the portion of the Prize which is intended for him/her. The name of the Travel Companion may not be changed once the release form has been received by the Sponsor.

The Winner and his/her Travel Companion must travel together both ways. Travel arrangements will be made by the Sponsor. The trip must be completed before September 15th, 2018 (“Travel Deadline”).

The reservations are subject to the availability of the air carrier and the hotel at the time of the reservation. The terms and conditions of the air carrier, the hotel and the Sponsor are applicable. Taxes, airport fees, custom duties, entry fees and tourist cards, surcharges, insurance charges, vaccination expenses, any personal expenses, personal travel insurance and travel documentation are not included in the Prize and are solely the responsibility of the Winner and his/her Travel Companion.

On the travel date, the Winner and his/her Travel Companion must have the legal right to leave Canada and to return to Canada and must have the legal right to enter and leave the United States of America. The Winner and his/her Travel Companion are fully responsible for obtaining, at their own expense, all documentation necessary for the trip as required by the authorities concerned, including, without limitation, visas, passports and vaccination certificates. These must be obtained before departure. The Winner and his/her Travel Companion must comply with the Contest validity dates and accept the alternatives proposed by the Sponsor, if this proves necessary. No extension of the trip will be permitted.

Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Contest is unlawful and subject to possible legal action by Sponsor. Sponsor reserves the right to terminate, suspend or amend the Contest, without notice, and for any reason, including, without limitation, if Sponsor determines that the Contest cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. In the event any tampering or unauthorized intervention may have occurred, Sponsor reserves the right to void suspect entries at issue. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.

INDEMNIFICATION AND LIMITATION OF LIABILITY: BY ENTERING THE CONTEST, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES, THE FACEBOOK PLATFORM, ADMINISTRATOR, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE. SPONSOR AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE CONTEST.

PRIVACY: By entering information on the Contest entry form, entrant consents to the use of such information to administer, implement and fulfill this Contest. Entrants’ information will not be used for any other purpose.
