“The NHL Hat Trick Challenge™ Presented by Enterprise” (the “Promotion”) is sponsored by NHL Interactive CyberEnterprises, LLC, 1185 Avenue of the Americas, 13th Floor, New York, New York 10036 (“Sponsor”).
In order to enter the Promotion and be eligible to win a prize, an entrant must be a legal resident of the fifty (50) United States (including the District of Columbia) or Canada and at least the age of majority in his/her state or province of primary residence as of the date of entry into the Promotion (each such eligible United States or Canadian resident, as applicable, an “Entrant”). Registration is free and no purchase is necessary to participate at any time in the Promotion. The Promotion is void where prohibited by law. Employees, officers, representatives, agents, members and directors of Sponsor, the National Hockey League (“NHL”), the NHL’s Member Clubs, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., Enterprise Holdings, Inc. (“Enterprise”), SportsHub Technologies LLC, Disney Streaming Services LLC (“DSS”), each of the foregoing entities’ affiliates, licensors and prize providers, and any other person or entity associated with the development or administration of this Promotion (collectively, the “Ineligible Entities”), as well as such person’s immediate families, namely spouses, children, siblings and parents, and/or persons living in the same household as such persons, whether or not related, are not eligible to enter this Promotion or win a prize.
The Promotion begins at 6:00 P.M. Eastern Time (ET) on September 28, 2018, and ends upon the start time of the last Stanley Cup® Final game of the 2019 Stanley Cup® Playoffs (i.e., the game in a best-of-seven series by which one participating Member Club in the Stanley Cup® Final has won its 4th game against the other participating Member Club) (the “Promotion Period”). The Promotion Period consists of (A) a Regular Season Promotion (the “Regular Season Promotion”) that takes place during the 2018-19 NHL® Regular Season (“Regular Season”); and (B) a Playoffs Promotion (the “Playoffs Promotion”) that takes place during the 2019 Stanley Cup® Playoffs (the “Playoffs”). The Regular Season Promotion will begin at the start of the Promotion Period and will end upon the start of the last game of the Regular Season (currently scheduled for April 6, 2019). The Playoffs Promotion will begin on the first day of the Conference Quarterfinals (date to be announced) and will end upon the start of the last Stanley Cup® Final game. The Promotion Website’s (as defined below) computer is the official clock for all purposes of the Promotion.
4. HOW TO ENTER.
To enter, an Entrant must first either visit the Promotion website located at https://hattrick.nhl.com (the “Promotion Website”) or download and open the free NHL Hat Trick Challenge™ mobile application (the “App”), available for download on iPhone and Android mobile devices. An Entrant must then complete the following steps: (1) attempt to answer one of the three (3) daily questions posted on the Promotion Website and/or in the App (as applicable), after which the Entrant will be prompted to either “Sign in” with an existing NHL® account or, if the Entrant does not yet have an NHL® account, register (“Registration”) for an NHL® account by clicking on “Create Account” and follow the instructions to complete and submit the Registration form by providing the required contact information including first and last name, username (if requested), email, country, ZIP/postal code, favorite team (not required for Canadian Entrants) and the selection of a password; and (2) complete the entry process by creating an entry name (each, an “Entry” and collectively, the “Entries”) and clicking the “Register” button. Alternatively, an Entrant may first click on “Sign in” or “Create Account” located at the top right of the Promotion Website or in the menu section of the App, after which the Entrant will be prompted to complete the Entry by creating an entry name and clicking the “Register” button. Once you have completed the Entry process, follow the steps in Section 5 of these Rules in order to participate in the Promotion and have a chance to win prizes. It is free of charge to register for an NHL® account. An incomplete entry form does not constitute a valid Entry for purposes of this Promotion and will not be accepted. Although it is free to enter, standard message and data charges may be incurred if you use your mobile device to enter this Promotion (e.g., via the App).
LIMIT: ONE (1) REGISTRATION/ENTRY NAME PER PERSON AND PER EMAIL ADDRESS DURING THE PROMOTION PERIOD. No person may enter more than once by using different email addresses and no email addresses can be used to submit more than one (1) registration/entry name. Proof of submitting a registration/entry name or an Entry will not be deemed by Sponsor as proof of receipt or entry into the Promotion. Any attempted form of entry into the Promotion other than as described herein is void. Additional registrations/entry names from the same person and/or email address in excess of the number stated herein (including, for clarity, any subsequent registrations/entry names after the initial registration/entry name) will be disqualified. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents will void all Entries by that Entrant. Entries that are incomplete, garbled or corrupted are void and will not be accepted. All Entries become the property of Sponsor upon receipt and will not be acknowledged or returned.
5. HOW TO PLAY.
Overview- Full Regular Season Period and Full Playoffs Period Participation: After an Entrant has created an Entry, an Entrant may participate in the Promotion (either online on the Promotion Website or through the App) during the Regular Season Promotion and/or the Playoffs Promotion, as the case may be, by answering three (3) daily questions of a predictive nature about NHL® games played during the Regular Season and/or the Playoffs, as applicable. A different set of questions will be posted for each day of the Regular Season and Playoffs on which NHL® games are scheduled and such questions will specifically relate to the potential outcomes of such games to be played that day. An Entrant scores one (1) “hat trick” by correctly answering all three (3) questions posted for that day’s games, and if (as further described below) an on-ice hat trick occurs on that same day, such Entrant will instead score three (3) hat tricks. Even if an Entrant fails to correctly answer all three (3) questions, if an on-ice hat trick occurs on that same day then such Entrant will still earn one (1) hat trick so long as such Entrant does not leave any question unanswered. The objective of the Regular Season Promotion is to accumulate the most hat tricks over the course of the Regular Season (such period, the “Full Regular Season Period”). Similarly, the objective of the Playoffs Promotion is to accumulate the most hat tricks over the course of the Playoffs (such period, the “Full Playoffs Period”). At the end of the Full Regular Season Period, one (1) grand prize will be awarded to the Entrant with the highest score (i.e., most hat tricks accumulated during the Regular Season), subject to the Tie Breaker Rules defined below in the event of any ties. And at the end of the Full Playoffs Period, one (1) grand prize will be awarded to the Entrant with the highest score (i.e., most hat tricks accumulated during the Playoffs), again subject to the Tie Breaker Rules defined below in the event of any ties.
Overview- Additional Prizing Opportunities during the Regular Season: In addition to the foregoing, there are special promotional periods within both the Regular Season Promotion and Playoffs Promotion in which Entrants can also participate to have a chance to win additional prizing. Within the Regular Season Promotion, there are two promotional periods in addition to the Full Regular Season Period in which an Entrant may participate to have a chance to win additional prizing – Regular Season Periods and Weekly Periods – as follows:
Regular Season Periods: There are three (3) Regular Season Periods within the Regular Season Promotion in which Entrant has a chance to win additional prizing: First Period: October 3, 2018-November 25, 2018 (the “First Period”); Second Period: November 26, 2018-January 25, 2019 (the “Second Period”); and Third Period: January 30, 2019-April 6, 2019 (the “Third Period”) (each a “Regular Season Period” and together, the “Regular Season Periods”). One (1) prize will be awarded to each Entrant with the highest score (i.e. most hat tricks accumulated) in each of the respective Regular Season Periods (subject to the same Tie Breaker Rules defined below).
Weekly Periods: There are twenty-four (24) weekly periods (each a “Weekly Period” and together, the “Weekly Periods”) within the Regular Season Promotion in which Entrant has a chance to win additional prizing. One (1) prize will be awarded via random drawing at the end of each respective Weekly Period. Each hat trick earned by an Entrant during a given Weekly Period gives that Entrant one (1) entry into that Weekly Period’s random drawing. The Weekly Periods are listed below. While most Weekly Periods are seven (7) days long, some Weekly Periods are longer or shorter as designated below by one or two asterisks (as applicable).

Overview- Additional Prizing Opportunities during the Playoffs: Similarly, within the Playoffs Promotion, in addition to having the chance to win prizing at the end of the Full Playoffs Period (by earning as many hat tricks as possible throughout the Playoffs), there are four (4) Playoffs rounds (each a “Playoffs Round” and together, the “Playoffs Rounds”) in which an Entrant may participate to have a chance to win additional prizing. There are four (4) Playoffs Rounds over the course of the Playoffs: the Conference Quarterfinals, the Conference Semifinals, the Conference Finals, and the Stanley Cup® Final. One (1) prize will be awarded via random drawing at the end of each of the four (4) Playoffs Rounds. Each hat trick earned by an Entrant during a given Playoffs Round gives that Entrant one (1) entry into that Playoffs Round’s random drawing.
By entering, each Entrant acknowledges that his/her entry name and total “hat tricks” earned during the Regular Season Promotion and/or Playoffs Promotion (as applicable) may be publicly posted on the Promotion’s online leaderboard during the Promotion. An Entrant is not required to participate in any part of the Regular Season Promotion in order to be eligible to participate in the Playoffs Promotion, and vice-versa. However, for clarity, any hat tricks earned during the Regular Season will not roll over into the Playoffs. Additionally, any hat tricks earned during any Regular Season Period will not roll over into any subsequent Regular Season Period. All winners must comply with the winner notification requirements below.
Make Predictions/Selections: To answer the three (3) daily questions posted on a given day during either the Regular Season and/or Playoffs, as applicable, the Entrant will be required to go to the page within the Promotion Website or within the App in which such questions are posted. Again, three (3) questions will be posted for each day of the Regular Season and the Playoffs during which NHL® games are scheduled and will specifically relate to the games to be played that day. Such questions may be posted in advance of that day’s games but will be posted no later than 12:00 P.M. (i.e., noon) ET on the day on which such games are scheduled. The answer to each question is in multiple choice format with two options to choose from. An Entrant can answer each question by clicking on one of the two choices for that question. Once a choice is clicked, that choice is saved once it turns green. Answers must be submitted and locked in prior to the start time of each applicable game to which the question(s) relates; up until that time, an Entrant may change his/her answer to a question at any time by clicking on another choice if he/she so chooses. An Entrant must correctly answer all three (3) questions asked on a given day to earn a hat trick. If no NHL® games are scheduled on a given day, then no questions will be posted for that day.
On-Ice Hat Tricks: In the event that an NHL® player scores three (3) goals in a single NHL® game (and therefore achieves an on-ice hat trick), Entrants who have correctly answered all three (3) questions on that same day will earn a total of three (3) hat tricks for that day (as opposed to one (1) hat trick for that day). Entrants who answered all three (3) questions (even if answered incorrectly) on that same day will earn one (1) hat trick for that day (as opposed to none). For clarity, a hat trick for incorrect answers can only be earned on the same day that an on-ice hat trick has occurred and only if all three (3) questions for that day were answered. No more than three (3) hat tricks will be awarded to an Entrant for a same day on-ice hat trick event, regardless of how many on-ice hat tricks occur that day.
Regular Season Promotion Winner Selection:
Full Regular Season Period Winner Selection:At the end of the Regular Season Promotion, there shall be one (1) grand prize winner (the “Regular Season Grand Prize Winner”) – i.e., the Entrant with the most hat tricks scored over the course of the Full Regular Season Period will respectively be deemed the potential Regular Season Grand Prize Winner. Any ties will be governed by the Tie Breaker Rules below. Prizing is set forth in Section 8 of these Rules.
Regular Season Period Winner Selection:There shall be one (1) winner of each Regular Season Period – i.e., the Entrant with the most hat tricks scored over the course of the First Period (such winner, the “Regular Season First Period Winner”); the Entrant with the most hat tricks scored over the course of the Second Period (such winner, the “Regular Season Second Period Winner”); and the Entrant with the most hat tricks scored over the course of the Third Period (such winner, the “Regular Season Third Period Winner) (each a “Regular Season Period Winner” and together, the “Regular Season Period Winners”). Any ties will be governed by the Tie Breaker Rules below. Prizing is set forth in Section 8 of these Rules.
Weekly Period Winner Selection: For each Weekly Period, there shall be one (1) winner (such winner, a “Weekly Period Winner”) determined by a random drawing conducted by the Sponsor-designated judges from a pool of all Entrants who scored hat tricks during the respective Weekly Period. Each hat trick scored during a given Weekly Period will constitute one entry into that Weekly Period drawing to determine the winner of that Weekly Period. The random drawing for each Weekly Period shall take place within three (3) business days after the end of each such Weekly Period. If the potential Weekly Period Winner is later found to be ineligible, then in accordance with Section 7 of these Rules that winner shall be disqualified, and Sponsor may in its sole discretion select an alternate winner for that Weekly Period by conducting a second random drawing from all remaining eligible Entrants (i.e., those who scored hat tricks in that Weekly Period). Weekly Period prizing is set forth in Section 8 of these Rules.
Playoff Promotions Winner Selection:
Full Playoffs Period Winner Selection:At end of the Playoffs Promotion, there shall be one grand prize winner (the “Playoffs Grand Prize Winner”) – i.e., the Entrant with the most hat tricks scored over the course of the Full Playoffs Period will respectively be deemed the potential Playoffs Grand Prize Winner. Any ties will be governed by the Tie Breaker Rules below. Prizing is set forth in Section 8 of these Rules.
Playoffs Round Winner Selection: For each Playoffs Round, there shall be one (1) winner (such winner, a “Playoffs Round Winner”) determined by a random drawing conducted by the Sponsor-designated judges from a pool of all Entrants who scored hat tricks during the respective Playoffs Round. Each hat trick scored during a given Playoffs Round will constitute one entry into that Playoffs Round drawing to determine the winner of that Playoffs Round. The random drawing for each Playoffs Round shall take place within three (3) business days after the end of each such Playoffs Round. If the potential Playoffs Round Winner is later found to be ineligible, then in accordance with Section 7 of these Rules that winner shall be disqualified, and Sponsor may in its sole discretion select an alternate winner for that Playoffs Round by conducting a second random drawing from all remaining eligible Entrants (i.e., those who scored hat tricks in that Playoffs Round). Playoffs Round prizing is set forth in Section 8 of these Rules.
For all promotions, the odds of winning depend on the number of eligible Entries received, the number of hat tricks accumulated by each eligible Entrant, and the skill of each Entrant in his or her knowledge of the NHL® teams and in selecting the correct answers needed to earn hat tricks during the various periods of the Promotion Period.
Tie Breaker Rules: The following Tie Breaker Rules shall be followed in the event of any ties to determine the respective Regular Season Period Winners, the Regular Season Grand Prize Winner, or the Playoffs Grand Prize Winner, in each case as applicable.
Regular Season Period Winners, Regular Season Grand Prize Winner or Playoffs Grand Prize Winner: : If more than one Entrant is tied for the most hat tricks scored (“First Place”) at the end of the applicable period (i.e., at the end of a Regular Season Period, the Full Regular Season Period or the Full Playoffs Period, as the case may be), the respective Entrant involved in the tie with the most correct answers submitted during such period shall be deemed the potential winner for such period (i.e., a Regular Season Period Winner, the Regular Season Grand Prize Winner or the potential Playoffs Grand Prize Winner, as applicable). In the event that more than one Entrant involved in the tie shall also be tied for the most correct answers within the respective period, then the potential winner for that period shall be selected from those tied Entrants by a random drawing conducted by the Sponsor-designated judges. Any remaining Entrants who tied for First Place in a given period but who were not selected as the potential winner for such period after applying the tie breaker rules above are not eligible to win the prize to be awarded to such potential winner (once confirmed as a winner in accordance with these Rules). By way of example, if two Entrants tied for First Place at the end of the Full Regular Season Period, the winner of the tie breaker (either by having the most correct answers or by being selected in the random drawing) is the Regular Season Grand Prize Winner and the other Entrant will not win the prize to be awarded to the Regular Season Grand Prize Winner (i.e., the Regular Season Grand Prize, as set forth below in Section 8 of these Rules). As another example, if three Entrants tied for First Place at the end of the Full Playoffs Period, then the winner of the tie breaker is the Playoffs Grand Prize Winner and the other two Entrants will not win the prize to be awarded to the Playoffs Grand Prize Winner (i.e., the Playoffs Grand Prize, as set forth below in Section 8 of these Rules).
The following examples further illustrate the application of these Tie Breaker Rules.
Example #1: If, at the end of the Full Regular Season Period, three Entrants tie for First Place and each of these Entrants had a total number of 50 correct answers during the Full Regular Season Period, then a random draw shall be conducted amongst all three Entrants to select the Regular Season Grand Prize Winner. The remaining Entrants not selected will not win the Regular Season Grand Prize.
Example #2: If, at the end of the Full Playoffs Period, three Entrants tie for First Place and each of these Entrants had a total number of 50 correct answers during the Full Playoffs Period, then a random draw shall be conducted amongst all three Entrants to select the Playoffs Grand Prize Winner. The remaining Entrants not selected will not win the Playoffs Grand Prize.
Example #3: If, at the end of the Full Regular Season Period, three Entrants tie for First Place and their total number of correct answers during the Full Regular Season Period is 50, 50 and 40, respectively, then a random draw shall be conducted to select the Regular Season Grand Prize Winner from the two Entrants who each had 50 correct answers. The remaining Entrants (i.e. the loser of that draw and the Entrant who had 40 correct answers) shall not win the Regular Season Grand Prize.
In addition to participating in the Promotion on an individual basis, each Entrant may also participate in group or league play by either setting up his or her own group or by joining another group already established by another Entrant. Entrants within a particular group/league compete against one another by using the same picks made by such Entrants in individual play. The Entrant with the highest score within a particular group/league will be deemed to be the winner of that group/league. Participating in group or league play is only for bragging rights and Entrants will not be entitled to any prize whatsoever on account of having the highest score in a particular group or league.
6. AGREEMENT TO OFFICIAL RULES.
In order to enter the Promotion or receive a prize, Entrant must fully comply with the Rules and, by entering, Entrant represents and warrants that Entrant agrees to be bound by these Rules and the decisions of the Sponsor-designated judges, whose decisions shall be binding and final in all respects relating to this Promotion. Each Entrant by entering further agrees to waive any rights to claim ambiguity with the Promotion or these Rules.
7. NOTIFICATION OF WINNERS.
Potential winners will be determined by Sponsor’s representatives located at the NHL office in New York, NY, on the day after the applicable promotional period. Potential winners will be notified using the information provided on winner’s Registration. Potential winners will be notified by email and/or telephone, at Sponsor’s discretion, within three (3) days after the conclusion of the applicable period.
A potential winner must comply with all terms and conditions of these Rules. Winning is contingent upon fulfilling all requirements, including the requirements of this section. A potential winner is not an official and confirmed winner until he/she has completed, signed and returned all documentation required by Sponsor in its sole discretion, including, but not limited to, an Affidavit of Eligibility, Publicity Release (except where prohibited by law) and Liability Waiver and a tax form, if applicable (together, the “Release Forms”), and the eligibility of the potential winner has been verified. If a potential winner is a resident of Canada, that Entrant will also be required to answer, without mechanical or other assistance, Sponsor’s mathematical, skill-testing question (the “Skill Question”) as set forth in the Release Forms. Each potential winner must complete and return all necessary Release Forms. All Release Forms must be received by the deadline date communicated to the potential winner at time of notification of winning. If a potential winner does not complete and return to Sponsor all Release Forms necessary within the time given, he/she will forfeit the prize to be awarded and an alternate winner may be chosen at Sponsor’s sole discretion. Sponsor is not responsible for documents not received within the required timeframe. In the event: (a) a potential winner cannot be reached for whatever reason after a reasonable effort has been exerted based on the information stated in the Registration, (b) of noncompliance with the above or within any of the aforesaid time periods, (c) a potential winner is found to be ineligible to enter this Promotion or receive the given prize, (d) a potential winner cannot or does not comply with the Rules, (e) any email notification to a potential winner is returned as undeliverable for whatever reason, (f) a potential winner fails to timely return to Sponsor fully completed and executed Release Forms, (g) a potential winner is a Canadian Entrant and that Entrant has failed to answer or has incorrectly answered the Skill Question, or (h) the potential winner declines to receive the prize to be awarded for whatever reason, the potential winner shall be disqualified from this Promotion and an alternate potential winner may be selected from among the other eligible entries received at the sole discretion of the Sponsor – i.e., in the case of a disqualified Weekly Period Winner, or Playoffs Round Winner, by conducting a second random drawing from all remaining eligible Entrants for the respective Weekly Period or Playoffs Round (these alternate random draws will only occur once for each Weekly Period or Playoffs Round); and in the case of a disqualified Regular Season Period Winner, Regular Season Grand Prize Winner or Playoffs Grand Prize Winner, by awarding the applicable prize to the eligible Entrant with the next highest score in the applicable period (i.e., Regular Season Period, Full Regular Season Period or Full Playoffs Period, as the case may be) subject to application of the Tie Breaker Rules set forth above. Each such alternate winner must then comply with the notification requirements in this Section 7 in order to receive a prize.
There are multiple levels of prizing available to be won: (1) For the Regular Season Promotion: the Regular Season Grand Prize, Weekly Prizes, and Regular Season Period Prizes; and (2) for the Playoffs Promotion: the Playoffs Grand Prize and Playoffs Round Prizes. All prizes shall be awarded by Sponsor and are set forth below. There is no restriction on the number of prizes that an Entrant may win. Therefore, an Entrant may win multiple Weekly Periods, Regular Season Periods, and Playoffs Rounds and still remain eligible to win the Full Regular Season Period and/or Full Playoffs Period.
Regular Season Grand Prize
For the Full Regular Season Period, there is one (1) prize to be awarded: the confirmed Regular Season Grand Prize Winner shall receive the Regular Season Grand Prize of $20,000.00 USD cash (ARV: $20,000.00 USD; provided in the form of a check).
Weekly Prizes One (1) prize (the “Weekly Prize”) shall be awarded to the confirmed winner of each Weekly Period. There is only one (1) winner per Weekly Period, as determined by a random drawing.
Each Weekly Prize shall each consist of two (2) tickets to a Regular Season NHL® game. The winner shall choose which game among four (4) choices provided by Sponsor. The four (4) possible games to be selected including seating shall be made by Sponsor in its sole discretion and shall be subject to availability. Transportation is not included as part of any Weekly Prize. Each potential winner acknowledges that at any time during the Regular Season, tickets may no longer be available (as determined by Sponsor in its sole discretion) in which case Sponsor shall provide as a substitute prize a Shop.NHL.com gift certificate (a “Shop Card”) in the amount of $300.00 (US$s or CDN$s, as applicable based on the winner’s residency). Further, even if tickets remain available, any Weekly Prize winner may elect to receive the Shop Card in lieu of receiving tickets to a Regular Season game. In sum, there is one Weekly Prize per Weekly Period for a total of twenty-four (24) Weekly Prizes available to be won during the entire Promotion, with each such Weekly Prize valued at an approximate retail value (“ARV”) of $300.00 USD for a combined total ARV of all Weekly Prizes of approximately $7,200.00 (USD). Shop Cards are redeemable only online at Shop.NHL.com. Shop Cards may not be returned, redeemed for cash or used as payment on or credit to any credit card accounts. Shop Cards are not valid on prior purchases, and no credit or cash shall be given for any unused portion. A Shop Card will not be replaced if lost or stolen. Winner will be subject to all terms and conditions of the gift certificate as stated on the gift certificate. In the event the winner of a Shop Card purchases merchandise from Shop.NHL.com whose stated value exceeds the amount remaining on the Shop Card, the winner will be solely responsible for payment of those excess costs.
Regular Season Period Prizes
For the Regular Season Period, there are three (3) prizes to be awarded: the confirmed Regular Season First Period Prize Winner, Regular Season Second Period Prize Winner, and Regular Season Third Period Prize Winner shall each receive $10,000.00 USD cash (provided in the form of a check) for a combined total ARV of all Regular Season Period Prizes of $30,000 USD.
Playoffs Promotion Prizing
Playoffs Grand Prize
For the Full Playoffs Period, the confirmed Playoffs Grand Prize Winner shall receive the Playoffs Grand Prize. The Playoffs Grand Prize is $10,000 USD cash (ARV: $10,000 USD, awarded in the form of a check).
Playoffs Round Prizes
One (1) prize (the “Playoffs Round Prize”) shall be awarded to the confirmed winner of each Playoffs Round during the Playoffs. There is only one (1) winner per Playoffs Round, as determined by a random drawing. As there are four (4) Playoffs Rounds during the Playoffs, there will be a maximum of four (4) Playoffs Round Winners.
Each Playoff Round Prize shall each consist of, at the Playoffs Round Winner’s discretion, one (1) customized NHL® jersey of such winner’s favorite NHL® team or one (1) authentic NHL® jersey of such winner’s favorite NHL® player. ARV of each Playoffs Round Prize is $200.00 USD. As such, the total ARV of all four (4) Playoffs Round Prizes is $800.00 USD.
Total ARV of all Prizes awarded during the Regular Season (i.e., all Weekly Prizes, Regular Season Period Prizes, and the Regular Season Grand Prize) is $57,200 USD. Total ARV of all Prizes awarded during the Playoffs (i.e., Playoffs Round Prizes and the Playoffs Grand Prize) is $10,800 USD. Total ARV of all Prizes awarded during the entire Promotion (i.e., Regular Season Promotion and Playoffs Promotion) is $68,000 USD. No more than the number of prizes stated in these Rules will be awarded. ARV of all prizes is in U.S. dollars. Actual value of any prize awarded may be lower or higher at the time of its fulfillment, and any difference between actual value and stated ARV (if actual value is lower than stated ARV) will not be awarded. All details and other restrictions of prizes not specified in these Rules will be determined by Sponsor in its sole discretion. Prizes are non-transferable, non-refundable and must be accepted as awarded. No cash or other substitutions may be made, except by Sponsor who reserves the right, in its sole discretion, to substitute a prize (or portion thereof) with another prize (or portion thereof) of equal or greater value whether due to the unavailability of a prize or prize component, or for any other reason. Each winner is solely responsible for any and all applicable federal, state, provincial, local and/or any other applicable taxes and/or other costs and expenses associated with accepting, redeeming and/or using a prize which are not specifically mentioned herein. Prizes will be delivered to confirmed winners. Resale of NHL® game/event tickets is prohibited. Winner and winner’s guest must abide by all venue policies and game/event ticket terms and conditions. Sponsor reserves the right to revoke the full or partial prize from any winner or winner’s guest who it or venue personnel deem may, in its sole discretion, be intoxicated, be a safety risk, have violated any venue policy or law, or may bring Sponsor into disrepute.
Without limitation, except where legally prohibited, acceptance of a prize constitutes a winner’s agreement and consent for Sponsor and Enterprise to use the winner’s name, address (city & state/province), image likeness, and persona for purposes of advertising, promotion and publicity relating to the Promotion and any successor version of the Promotion, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable or World Wide Web, without additional compensation, limitation, restriction, notice, review or approval.
10. RELEASE; INDEMNIFICATION; DISCLAIMER OF WARRANTY; LIMITATION OF LIABILITY.
By participating in the Promotion, each Entrant agrees to forever and irrevocably release and hold harmless each of the Ineligible Entities and each of their respective officers, directors, governors, members, partners, partnerships, principals, employees, volunteers, representatives, agents, affiliates, related entities, successors and assigns (collectively, the “Released Parties”), from any and all liability for any loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury (including emotional distress), death, attorneys’ fees, loss of enjoyment, defamation, invasion of privacy, or the violation of personal or publicity rights, which may occur in connection with (a) the Promotion or any element thereof, including entry or participation therein, (b) delivery, possession, acceptance and/or use or misuse of any prize or component thereof, or (c) participation in any Promotion-related activity or prize-related activity. In addition, by participating in this Promotion, each Entrant agrees to indemnify and hold harmless the Released Parties from and against any and all damages, losses, amounts paid in settlement, costs and expenses (including reasonable attorneys’ fees and expenses) incurred by any of the Released Parties in connection with any third-party claim, demand, liability, suit, proceeding or action arising out of or resulting from (i) breach or alleged breach of any representations, warranties or agreements of Entrant hereunder, or (ii) Entrant’s possession, use or misuse of any prize or component thereof. Each Entrant hereby acknowledges that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any of the prizes (or any components thereof). Without limiting the generality of the foregoing, each prize is provided “as is” without warranty of any kind, either express or implied, and the Released Parties hereby disclaim all such warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purposes and/or non-infringement. The Released Parties are not responsible or liable for Entries that are: (i) entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), (ii) in excess of the stated entry limit, or (iii) illegible, incorrect, inaccurate, delayed, late, forged, destroyed, lost, misplaced, stolen, misdirected, tampered with, incomplete, deleted, damaged, garbled, altered or otherwise not in compliance with these Rules, whether caused by (A) any of the equipment or programming associated with or utilized in the Promotion, (B) any technical or human error which may occur in the processing of Entries in the Promotion, or (C) for failure to receive Entries due to transmission failures or technical failures of any kind, and all such Entries will be disqualified. In addition, the Released Parties shall have no responsibility or liability in connection with: typographical errors in Promotion promotional material; cancellations and/or delays or any change by any company or any other persons providing any component of a prize due to reasons beyond the control of any of the Released Parties; any interruptions/postponement/cancellation of Promotion; human error; any technical malfunctions of the computer on-line system, computer dating mechanism, computer equipment, software, or internet service provider utilized by any of the Released Parties or by Entrant; interruption or inability to access the Promotion, any Promotion-related Web pages, or any on-line service via the Internet due to hardware or software compatibility or other problems; any damage to Entrant’s (or any third person’s) computer and/or its contents related to or resulting from any part of the Promotion; any lost/delayed data transmissions, omissions, interruptions, defects; and/or any other errors or malfunctions, even if caused by the negligence of any one or more of the Released Parties.
11. GENERAL CONDITIONS.
The decision of Sponsor in respect of any matter relating to this Promotion is final and binding in all respects. Sponsor reserves the right to terminate, cancel, suspend and/or modify the Promotion (with the consent of the Régie, (as defined below), as required under the Rules and Regulations of the Régie), if intervening circumstances warrant, within Sponsor’s sole discretion, due to any fraud, virus or other technical problem which corrupts the administration, security, or proper play of the Promotion, or for any other reason. In the event any daily questions pertain to a game that has been postponed or rescheduled (resulting in a delay in determining whether a hat trick has been achieved), any applicable hat trick earned will be determined once the outstanding game has taken place and will be applied retroactively to the original time period in which the question was originally presented. In the event of overlapping Playoffs Rounds (if any), whereby daily questions for a given day relate to more than one Playoffs Round taking place at the same time, entries earned from applicable hat tricks will be entered into the drawings for each respective Playoffs Round. Notice of any such events may, at Sponsor’s discretion, be posted on the Promotion Website and/or emailed to Entrants. In the event of a termination, cancellation, suspension and/or modification of the Promotion, Sponsor reserves the right to award a prize from among the eligible Entries received up to the time of the termination, cancellation, suspension and/or modification, as applicable. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Rules shall not constitute a waiver of that provision. In case of dispute as to the owner of an Entry, the Entry will be deemed to have been submitted by the authorized account holder of the email address from which the Entry is made. The “authorized account holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be requested to provide the Sponsor or its designees with proof that the potential winner is the authorized account holder of the email address associated with the winning entry. If a dispute cannot be resolved, the Entry will be deemed ineligible, and an alternate potential winner may be selected in Sponsor’s sole discretion (in accordance with the procedures in Section 7 above).
With regard to United States (including District of Columbia) Entrants, any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved exclusively by the United States District Court for the Southern District of New York, U.S.A. or the appropriate New York State Court located in New York County, New York, U.S.A. and all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of the Entrants and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of New York, U.S.A. without giving effect to any choice of law or conflict of law rules (whether of the State of New York, U.S.A. or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York, U.S.A. With regard to Canadian Entrants, any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved exclusively by the courts of the Province of Ontario and all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of the Entrants and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the Province of Ontario, Canada and the laws of Canada applicable therein without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario; provided, however, that the jurisdiction of the Régie des alcools, des courses et des jeux (the “Régie”) shall apply in relation to a Québec Entrant with respect to any matter within the jurisdiction of the Régie. With regard to Québec Entrants, any litigation respecting the conduct or organization of this Promotion may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. Applicable to all Entrants: Except where prohibited by law, Entrants agree that: (i) any and all such disputes, claims and causes of action shall be resolved individually, without resort to any form of class action, (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees, (iii) under no circumstances will Entrants be permitted to obtain awards for, and Entrants hereby waive all rights to claim, indirect, punitive, incidental, consequential and/or any other damages other than actual out-of-pocket expenses, (iv) they waive any and all rights to have damages multiplied or otherwise increased, (v) they irrevocably consent to the personal jurisdiction of the aforesaid courts, as applicable to such Entrant, and waive any claim of forum non conveniens or lack of personal jurisdiction that they may have, (vi) if any provision of these Rules is declared invalid or unenforceable, such provision will be deemed modified to the extent necessary and possible to render it valid and enforceable, that in any event, the unenforceability or invalidity of any provision will not affect any other provision of these Rules, and these Rules will continue in full force and effect, and be construed and enforced, as if such provision had not been included, or had been modified as described above, as the case may be.
