Carter’s | OshKosh
The Carter’s | OshKosh Refer-a-Friend Contest (the “Contest”) is intended to be conducted in Canada only and shall be construed and evaluated according to applicable Canadian law. No purchase necessary. By entering this Contest, you agree to be bound by these official rules and regulations (the “Rules”). This Contest, which may be accessed via social media platforms, including Facebook, Instagram and Twitter, is in no way sponsored, supported or organized by Facebook, Instagram or Twitter.
Overview: The Contest is sponsored and administered by Carter’s Inc. (“Carter’s | OshKosh”). For the purposes of these Rules the “Contest Group” consists of Carter’s | OshKosh, its affiliates and any other third party involved in the administration of this Contest. Carter’s | OshKosh reserves the right, subject to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) with respect to residents of Quebec, to cancel or amend the Contest or these Rules without prior notice. Any changes will be posted to win.cartersoshkosh.ca.
Entry Period: The entry period (“Entry Period”) for the Contest starts on June 15, 2017 at 12:00:01 a.m. Eastern Time and ends on June 25, 2017 at 11:59:59 p.m. Eastern Time.
Eligibility: The Contest is open to legal residents of Canada who have reached the age of majority in his or her jurisdiction of residence at the time of entry in to the Contest. For sake of clarity, both the Initial Entrant (as defined below) and the Invited Friend (as defined below) must satisfy these requirements. Excluded from eligibility are officers, directors, employees, agents and representatives of the Contest Group, and any immediate family members (defined as parents, siblings, children and spouses, regardless of where they live) or households (whether or not related) of such officers, directors, employees, agents and representatives.
How to Enter: There are two ways to enter the Contest as set out below. Each entry shall be submitted on behalf of a team of two individuals. Each successfully completed entry is an “Entry” and collectively, “Entries”.
Main Method of Entry: The first team member (the “Initial Entrant”) shall complete all mandatory fields of the entry form online and submit the completed form online during the Entry Period. The online entry forms is located at win.cartersoshkosh.ca. Upon successful submission of the Initial Entrant’s online entry form, he or she will receive a unique link to a URL via email. The email containing the URL must be sent to their desired team member in the Contest (the “Invited Friend”). The Initial Entrant can only send the invite to a friend and family members with whom they have a personal relationship. The Invited Friend must open the email that the Initial Friend forwarded, open the URL in a web browser and complete all mandatory fields of the linked online entry form and submit as instructed during the Entry Period. An Entry shall not be completed until successful submission of the Invited Friend’s entry form. Upon submission of his or her online entry form, the Invited Friend will receive an email containing a unique link to another URL giving them the opportunity to become an Initial Entrant by sending the email to a friend or family with whom they have a personal relationship.
Alternative Method of Entry: Teams who prefer not to submit entry forms online may enter by printing two copies of the online entry form available at win.cartersoshkosh.ca, having each team member complete one of the printed entry forms and then send the completed entry forms for both team members to the following address: Carter’s |OshKosh Refer-a-Friend Contest, c/o A&C, 119 Spadina Avenue, Suite 900. Toronto, ON, M5V 2L1, Canada. Completed entry forms must be postmarked during the Entry Period, and received by June 25, 2017. If submitted separately, each entry form must indicate the identity of the other team member. Any mailed entry form will not be deemed incomplete if it does not contain an email address provided that all other required fields are complete and a phone number is included.
There is no purchase requirement to enter the Contest. Purchases from Carter’s | OshKosh do not improve the chances of winning. Entrants are responsible for the cost of their connection to the Contest web page via the Internet. Carter’s | OshKosh does not guarantee continuous, uninterrupted or secure access to the Contest web page or website.
The Initial Entrant and his/her Invited Friend will only be allowed to enter as part of the same team once. Additionally, no individual may be an Initial Entrant for more than one Entry, and no individual may be an Invited Friend for more than one Entry. For greater clarity, an individual may only be an Initial Entrant once during the Contest Period and an Invited Friend once during the Contest Period. Any attempt or suspected attempt to circumvent these limitations by using multiple email addresses or pen names, or any use of robotic, automatic, programmed or any entry methods not authorized by these rules, shall be deemed as tampering and will void all Entries for such entrants. All Entries that are incomplete, illegible, damaged, contain an erroneous phone and/or email address or do not conform to or satisfy any condition of the Rules may be disqualified by Carter’s | OshKosh.
Whether you are the Initial Entrant or the Invited Friend, by entering the Contest you hereby warrant that all information submitted by you is true, current and complete. Carter’s | OshKosh reserves the right to verify the eligibility of Initial Entrants and Invited Friends. The contact details you provide with your Entry may be used to notify Potential Winners (as defined below) and send any prizes so you need to make sure it is correct. Carter’s | OshKosh does not accept responsibility for lost, damaged, invalid or illegible Entries.
Prize. There are two (2) prizes, one per winning team. Each prize consists of a $1000 gift card that may be redeemed online at www.cartersoshkosh.ca or in-store at any Canadian Carter’s | OshKosh location (each a “Prize” and collectively “Prizes”). No substitutions, refunds, transfers, or cash equivalent will be allowed. Gift cards are subject to certain terms and conditions, which are set out on the card. In the unlikely event that the Prize should become unavailable or unredeemable, Carter’s | OshKosh reserves the right to substitute an alternative prize which it reasonably determines as being of equal value. A Prize will be awarded to the Initial Entrant on behalf of the Initial Entrant and the Invited Friend.
All personal information provided by entrants in relation to this Contest will only be used by Carter’s | OshKosh and its agents for the purposes of administering the Contest. While not required to participate in the Contest, you may be invited to opt-in to receive promotional emails from the Carter’s | OshKosh.
General Conditions: Winning a Prize is contingent on fulfilling all the requirements set forth herein. Mass Entries, automated Entries, Entries submitted by third parties, and any Entries or Prize claims that are late, fraudulent, or delayed will be void. All Entries and Prize claims are subject to verification. Proof of entry submission does not constitute proof of receipt. Entrants agree to abide by these Rules. Decisions of Carter’s | OshKosh will be final and binding on all matters pertaining to this Contest, subject only to the approval of the Regie where required. Contest is subject to all applicable federal, provincial, territorial and municipal laws. Void where prohibited. Carter’s | OshKosh reserves the right to correct any typographical, printing, computer programming or operator errors. Carter’s | OshKosh’s failure to enforce any term of these Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. If any provision of these Rules is determined to be invalid or otherwise unenforceable, then the Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. Should a winning team make any false statement(s) in any document referenced above, that winning team may be required to promptly return to Carter’s | OshKosh the Prize, or the cash value thereof. Carter’s | OshKosh reserves the right at its sole discretion to disqualify any person or team who tampers or attempts to tamper with the entry process, the operation of the Contest, violates these Rules, or acts with intent to annoy, abuse, threaten or harass any other person. WARNING: ANY ATTEMPT BY AN ENTRANT OR TEAM OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
Limitations of Liability and Releases: BY PARTICIPATING IN THIS CONTEST, EACH ENTRANT (WHICH INCLUDES INITIAL ENTRANTS AND INVITED FRIENDS) AGREES THAT THE CONTEST GROUP AND THEIR RESPECTIVE DIRECTORS, OFFICERS, OWNERS, PARTNERS, SHAREHOLDERS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “RELEASEES”) HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANT AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM A PRIZE, INCLUDING THE ACCEPTANCE, POSSESSION, MISUSE OR USE OF THE PRIZE. FURTHER BY PARTICIPATING IN THIS CONTEST, EACH ENTRANT AGREES THAT RELEASEES HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANT AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM: A) ENTRY OR PARTICIPATION IN THIS CONTEST, INCLUDING ACCESS TO AND USE OF THE CONTEST WEBSITES, OR B) ANY CLAIMS BASED ON PERSONALITY OR PRIVACY RIGHTS, DEFAMATION OR MERCHANDISE DELIVERY. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you.
Without limiting the foregoing, the Releasees shall not be responsible for: (a) any incomplete or inaccurate information that is caused by the Contest Websites users, or by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of submissions in the Contest; (b) lost, interrupted, or unavailable network, server, service provider, on-line systems, telephone networks or telephone lines, or any other connections; (c) the theft, destruction, loss or unauthorized access to, or alteration of, Entries; (d) any problems with, or malfunctions or failures of, telephone networks or lines, computers or computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (e) garbled transmissions or miscommunications; (f) failure of any notification to be received by or from the Sponsor for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (g) damage to a user’s computer equipment (software or hardware) occasioned by participation or downloading of materials related to this Contest; (h) printing, distribution, programming or production errors, and any other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise; or (i) technical, pictorial, typographical or editorial errors or omissions contained herein.
Change of Contact Information: It is the entrant’s sole responsibility to notify Carter’s | OshKosh in writing at the address indicated above if he/she changes his/her address or other contact information. All corrections must be received by June 25, 2017.
Quebec Residents: For entrants from the province of Québec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
